It is not the first time that VO of Beijing embassy abused their power on us. My visa application there half year ago was rejected because I had advance parole (duel status). But INS clearly said that the advance parole should not be a factor in the decision making of issuing a visa. Both my lawyer and I faxed them (embassy) all legal documents from INS that supports our claim. The visa officer never replied me. They did address other mail/fax I send them in a very slow manner. It looks like they just want to dodge any responsibility. Eventually, I had to get a visa stamp from Mexico. The officer in Mexico told me that duel status is not an issue at all. What a contrast vs. the officer from Beijing embassy! Yes the Mexico officer heard my story at Beijing and he even tried to contact the Beijing officer to find out if there are other reasons.
Now my wife is rejected because of intention of immigration for her H4. Either the officers in Beijing embassy totally lack professional training or they think too high of themselves, maybe above the law. Yes, we can try to apply again and explain to them that 214(b) should not apply in H4 case. But it is just our words vs. their words. How could we win? That is why I really want to find a good immigration lawyer to go with my wife if possible.
Any other suggestions?
