美國憲法中製定了公民的各種權利,甚至包括犯罪嫌疑人的沉默權。對於作了壞事的人,不承認是最好的逃脫辦法,但為了逃脫法律的製裁隻能選擇說謊。為了避免這種情況的發生,美國憲法中規定了犯罪嫌疑人的沉默權,除了上麵引用的“Miranda warning”之外,當警方詢問已被拘禁的犯罪嫌疑人時,需要在詢問開始,宣讀犯罪嫌疑人的權利,通常是如下形式: You have the right to remain silent and refuse to answer questions. Do you understand? Anything you do say may be used against you in a court of law. Do you understand? You have the right to consult an attorney before speaking to the police and to have an attorney present during questioning now or in the future. Do you understand? If you cannot afford an attorney, one will be appointed for you before any questioning if you wish. Do you understand? If you decide to answer questions now without an attorney present you will still have the right to stop answering at any time until you talk to an attorney. Do you understand?
