一個租公寓遇到的問題

三月中看好了一間apartment，會在4月8日空出來，於是交了400美元的deposit和50美元application fee，計劃四月底搬進去。結果到了四月中，公寓管理人員來電話說原來的resident要到5月5號才能搬出來，說這是一個殘疾人，他沒辦法按時搬，問要不要force him out，當然我們說不要這樣做。又看了這個公寓別的apartment，都不滿意。

等了一個星期，這個公寓也沒有什麽別的說法，因為我們現在住的地方lease在4月30日到期，所以就決定把交的450美元要回來，趕緊到別的地方去找apartment。結果公寓的人說，隻能退回400美元的deposit，50美元的申請費已經用於run application了，不能退還。

要說50美元也不是什麽大事，丟了就算了。不過這事讓我老婆氣得夠嗆，特別是我老婆第二次去找他們，公寓那人態度還很壞。

所以想問一下，從法律上講，公寓那方是不是應該退回50美元的申請費呢？ 這件事明顯的是公寓那方的造成的問題，任何損失應該由他們承擔，而不應該由我們承擔。 因為他們不能履行承諾，實際給我們造成了損失，因為這麽短的時間在別的地方也很難找到滿意的apartment。

如果這種事要上法庭，又是怎麽做呢？隻是在電視上看過，小老百姓為百十美元的事爭論，到法庭上法官聽了陳述、看了證據，錘子一敲就定案了，還很有意思。想找公寓的manager，說是度假去了，說了昨天manager回電話，也沒消息。前天打電話到公寓總部，接電話的人把事情記下來了，到今天也還沒消息。
