Is your attorney a qualified family law attorney? If so he or should know Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA). Under UCCJEA, home state always has priority in jurisdiction in a child custody case so that Texas has the jurisdiction. Michigan will honor any order from Texas under good faith and credit clause of the Constitution. You cannot file in Michigan since you are not a resident there.

Re the Haiti divorce. You need to get a certified translation of the paper. If you contest it, you need to prove it is fake, including your signature. In any regards it has nothing to do with your child custody case.

Child custody depends on the court. In California, judges like to see joint custody based on the theory it is in the best interest of the child with both parents present. I do not know on what grounds your ex could ask for 100% custody. He may get visitation rights since it is a long distance relationship.

For the passport, you could get a court order to get a passport, which the presence of both parents or consent are not necessary. Go to state department website to find relevant information there.
