遭遇車禍，對方乘客索賠
 

車禍發生狀況如下：

 

駕駛在大雨天，我車內有一位同事，我開車，Toyota Corolla。刹車打滑導致車頭轉向。對方是Toyota pickup truck，兩位老墨撞在我的車門位置駕駛側，我的頭部有1.5英寸長的劃口，車子全毀。

對方車子前麵受創，沒有我們的嚴重。但事發後，警察到現場，不知如何，雙方都用救護車送醫院。警察報告說責任在我，我不服有申訴。

我的同事並未受傷，我的傷經兩個星期休息基本也恢複，照常上班。

對方駕駛並沒有索賠，而且人不見蹤影。但是對方的乘客卻與律師合作向我方索賠，且獅子大開口，稱要16-17萬賠償。

我們的保險是AAA的基本保險，對人員受傷賠償有每人1.5萬的上限限製。由於我們缺乏對車禍受傷的認識，後悔已晚， 所以有此困境。

我們的觀點是車禍責任在對方。盡管我們車打滑，但是已經完全停止，而且我們完全無助，對方不應該撞我們，現場隻有我們車內兩人，對方也是兩人老墨 ，無其他目擊證人。但對方駕駛失蹤，隻是乘客老墨在打官司，估計駕駛是非法移民。

目前，第一次調解失敗，對方拒絕我方保險公司給的賠償額，所以我們將要進入法庭的程序。

我們目前隻看到對方第一次被救護車拉到醫院的費用，並無其他受傷證據。從事故三個都未受傷的情況，對方乘客應是謊稱受傷訛詐。

懇請法律專家提供建議，我們應如何才能打贏這個官司。
