The police report is flawed.   When we first read report,  we immediately file the complaint that police put the words that we never said on the report.     We can dispute the police report from three perspective.

1.  The other driver claim he drive at 45 mph.    We drive at 40 mph.   The police report cite we drive unsafe speed ( due to weather condition).   It did not say other side drive at unsafe speed.  

2.  The reason seems police did not fully understand the situation about the accident.   Because it is heavy rain, he did not do through investigation.    For example, he did not ask our passenger any question about what happend.     You know we chinese,  in emergcy situation,   can't explain clearly in English.     He basically believe the other side story about how it happened.      He also try to fit our statement to support the other side story.     This is why I think we can attack the police report. 

3. From his description,  clearly show he get senario wrong.    

We will try to prove other side is main at fault.   However,  in this case, more importantly,   it is not other driver sue us.      It is the passenger.     He claims he is wounded and ask big money.        There are four people in this accident.   Both side has passenger.     Only one claim he is wound and ask money.

I believe the guy is pretend to be wounded.     Our lawyer initially told us he think he can settle the case without we pay from our pocket,  but he is wrong.    The other side keep increase the number during mediation.
