網上監視違憲嗎？ 斯諾登有罪嗎？
1. 鑒定標準:
---- 如果是為了一黨私利, 政府在網上監視打壓刪除或封鎖持不同政見者的言論的做法就是違憲， 因為言論自由是憲法賦予公民的權利。
---- 為了國家安全國家利益的網上監視, 則是無可非議的。
2. 斯諾登事件後, 有人在問: 美國政府監視電話網絡是否違反了憲法?
a. 政府監視是否違法違憲要看監視的內容及用於什麽目的。 是為了國家安全國家利益，還是為了打壓持不同政見者反對黨或政敵。 為了國家安全國家利益的監視則不違反憲法; 在中國，政府在網上監視打壓刪除或封鎖持不同政見者的言論的做法就是違憲，因為言論自由是憲法賦予我國公民的權利。 到目前為之，還沒聽說美國政府在網絡監視共和黨的活動。
b. 盡管網絡監視是為了國家的安全和利益而不是為了打壓持不同政見者反對黨或政敵，但也有可能不必要的使監視範圍太大而侵犯了公民的隱私權。 其實，這倒是美國人民現在最關心的，而且OBAMA也在采取各種措施糾正這些問題。 在這裏，實際上已是一個國家安全與個人隱私之間的如何平衡的問題。 有人說安全重於個人隱私，有人說更在意個人隱私。 怎麽辦？ 最後隻有國會根據民意投票表決一個法案。 實際上，機場的安檢也屬同類事情。
c. 其實，SNOWDEN 事件後，OBAMA已經提名了一個知名的＂公民自由隱私＂維權人士參與政府的網絡監視機構作為WATCHDOG。 實際上，國會也在對此調查聽證。
所以說，不用為人家操心。美國的司法是獨立的，憲法不是一張廢紙。
3. 美國前總統卡特評NSA網絡監視, 並表示憂慮和關切:

monitoring by the National Security Agency and that he feels such surveillance methods have been abused.

4. Snowden 有罪或無罪?
現在任何人（包括OBAMA你我及所有美國老百姓）說SNOWDEN有罪或無罪都不算數。OBAMA的司法部也隻是執行公務對此事調查取證，把這個案子呈交給獨立的法院起訴，同時SNOWDEN及他的辯護律師也會（應）到法院反駁司法部的指控，即＂對博＂公堂。 在美國，這麽大的案子，肯定還需要陪審團（JURY）來做有罪或無罪的票決。 這樣在法官的主持下，控辯雙方唇槍舌戰向大陪審團呈遞自己的證據並依法力爭。 最後，大陪審團經充分討論後投票表決被告人是否有罪。然後，向法庭宣讀結果（VERDICT）。

－－－ 如果他泄露的文件損害了美國國家安全或國家利益，那麽他就是有罪的。
－－－ 如果他泄露的文件僅僅是讓世人知道美國的監視擴大化，沒必要的監視一般老百姓，可能侵犯公民隱私，那麽，他是無罪的。 其實，美國政府已采取措施，取消沒必要的大規模收集DATA。
所以說，不要著急，慢慢看來。美國的司法是獨立的，憲法不是一張廢紙。 還記得嗎？在紐越時報與總統尼克鬆的＂泄密＂官司中，美國最高法院判總統敗訴，紐越時報贏了那場官司。 依據是新聞自由受憲法保護。

----不用擔心，人家有獨立的司法係統，會作出公正的判決的。 我們中國能做到這樣嗎？ 生生以莫須有的罪名把國家主席劉少奇撤職並打成叛徒冤死。中國憲法稱"公民有言論自由"，卻把寫了幾篇文章的劉曉波打入監獄。

更不幸大是，就在加州轟轟烈烈的抗議SCA5保衛教育權利的華人中，有許多人卻天天在網上詆毀謾罵攻擊民主製度，攻擊"言論自由", 攻擊劉小波博士許誌永博士，並不遺餘力地為中共獨裁辯護。 這是多麽的諷刺和悲哀！
