美國的 “Posse Comitatus” 法

法律中譯如下：

第十五條。自本法通過之日起，（任何人，譯注）不得以任何形式動用美國陸軍的任何部分，行“軍隊兼警”之職（posse comitatus---其發音是這樣的：趴see.卡密她提思），或以其他方式，為執行法律的目的而動用該等部隊，除非在憲法或國會法案明確授權使用上述部隊的情況下；本法禁止將（國會預算的撥款，譯注）撥款用於支付違反本條規定而動用任何部隊所產生的費用，任何故意違反本條規定的人均被視為犯有輕罪，一經定罪，可處以不超過一萬美元的罰款或不超過兩年的監禁，或並處罰款和監禁。

法律原文如下：

Sec. 15.  From and after the passage of this act it shall not be lawful to employ any part of the Army of the United States, as a posse comitatus, or otherwise, for the purpose of executing the laws, except in such cases and under such circumstances as such employment of said force may be expressly authorized by the Constitution or by act of Congress; and no money appropriated by this act shall be used to pay any of the expenses incurred in the employment of any troops in violation of this section and any person willfully violating the provisions of this section shall be deemed guilty of a misdemeanor and on conviction thereof shall be punished by fine not exceeding ten thousand dollars or imprisonment not exceeding two years or by both such fine and imprisonment.

該法是1878年6月18日生效的美國立法。此法的目的，是終止“美國內戰”結束後（1865年）實施的動用軍隊對原“南方各州”進行改造的過程。“改造”可行或不可行，但是，與“軍隊”無關了。

這之後，此法有些修正，包括加入其它軍種。另有其它立法，給“軍隊兼警”開了些小門縫，但那些小縫都是有極嚴格定義和極細致限製的。

換句話說，“Posse Comitatus Act”，是從根本上防止美國出現“六四事件”可能的一個大號“金鍾罩”，有147年曆史的“老文明”（Conservatism，hello）。

後注：當年的罰款一萬美金，是筆大錢，但那是147年前的大錢。國會如果有“豆汁部”要求的效率的話，早該立法修正，把一萬美金最少提高至一百萬美金。當你需要馬斯克的時候，他不再是“First Buddy”了，^_^。
