請大俠指點買 short sale 房的後續問題。

一直對一個gated 區感興趣，後來一個 listing agent 找到我們，說有一個房子是 private sale，原房主因麵子問題不願放在 multi listing，要價$980K。我們去看了房子，比較滿意，當時就簽了 listing agent 準備好的合同，listing agent 說 buyer’s agent 是他的朋友，隻是充個人頭，以免銀行扣 commission, 而他本人 handle 所有的事情。銀行 counter 到 $107萬，我們接受，11月20日 close escrow。早在拿到 short sale approval 後 listing agent 說原房主希望能再住一個月以便於找出租房搬出去。我們同意，並於11月8日寫了正式的email 給 listing agent 說應 cover 我們的 cost，每月$5300。11月24日新老房主及 listing agent 在房子見麵，我們的原意是檢查房子，簽 lease agreement，並收取房租。sellers提出要住到1月14日，因為在 holiday season 他們有許多旅行計劃，不能搬家。我們雖然希望早搬家以便孩子能及時在新學期開始的1月7日上學，但還是同意他們住，並當麵對他們說房租是 $5300。listing agent 以現在檢查房子不禮貌和需要立刻帶 sellers 去看出租房為由，讓我們盡快離開。回家後的當天我們寫了正式的“our position on short term lease”，以 pdf 的形式發給 listing agent，敦促他準備lease agreement讓 seller 簽字，並交納房租和押金。listing agent在兩天後按照我們的意思準備了lease agreement，email 給我們簽字，再 email 給 seller 簽字。最終十天後的12月4日listing agent 送來了 seller 的信封，seller 把每月房租“$5300”劃掉，改成 “$4000”，把 “$4000 security deposit” 劃掉，改成 “upgrade in the house”，兩處塗改的地方都沒有 initial 或簽名，形成事實上的無效 lease agreement，並附有 $4000 casher check。我們於12月5日發了 3 day notice, 並退還了 $4000 casher check，開始了 eviction。seller 第二天回應說是 listing agent 對他們說 $4000/month 是 buyers同意的, 而他們在幾年前買房後花費幾十萬 remodel，足以抵消我們要求的 security deposit。又說願意付房租以求和平解決。但時至今日也沒有收到新的 lease agreement 和我們要求的房租。我們準備明天 file 到 court。

我的問題是: (1) seller 夫婦二人均有工作，我們是否能通過 eviction 和 small claim court 拿回損失？或者要求 court 拍賣他們的名車：porsche, Mercedes etc.; (2) 可否訴 seller 和兩個 agent for breach the contract, 因為在 contract 裏說 “seller should make property available 5pm of the date of escrow close”;(3) 可否訴 listing agent for not communicate properly between seller and buyer, and refuse to pick up the difference he made; (4) listing agent 兩次說他把我們的 loan document 給 seller 看以證明我們的 cost，這是否侵犯了我們的 financial privacy。請各位大俠多多指點。
