There might be some kinds of government policy, but may be not strict. My agent, her boss, couple people from BoA and title company all said this during the close. But my agent and her boss suggest BoA two more items to be included as closing costs so that close to $1200 of the $1300 left over can be used, then we could move forward with need to fight for the rest $100. However, BoA people refused to do so.

What is the consequence if I try to find another lender? On contract, the expected closing day is 12/31/2012 and there is no penalty for extension. I might still have time to get another lender's approval.

Although loss the seller's $1300 closing assist is not very big deal, the way how BoA treated me and handled the situation in the past 4-5 days make me very angry. What options I have? Before I left, my agent's boss suggested that we add an addendement to say this $8500 can be used freely although I can not take cash back. Then, the seller (PNP bank) can use whatever left to add heating oil tank full, do services, and buy an insurance for the heater (about 19 years old heater). ALl these may add up to around $1600. This is partially because the heater did not work in the final walk through which might because there is no oil left. However, the BoA person called me and my agent at 7:00 pm and told us she can't put this in Hub1 either. So, I am thinking of find another lender.
