前些日子請教大家，關於房客欠租，Move out或驅逐，bbs.wenxuecity.com/tzlc/1714771.html，現在跟大家報告一下後續進展，並請教！
背景簡述：
房客欠租，5月份 2/3，6月份整個月。6月5日，給了3 Day Notice to Pay or Move out。
6月13日，房客說願意7月1日搬出，並分期付清Back Rent。
6月15日，跟房客商量說好6月22日搬出，第2天房客拒絕簽Move out Agreement（裏麵包含有房客願意分期付清BackRent的條款），但仍然答應6月22日搬出。
6月21日，房客說6月22日有事情，必須推到6月23日，商量無果，同意。當晚去出租房查看，一切照舊，沒有搬家的跡象。
6月23日，房客的母親（不在Lease Agreement上），打電話過來說，需要推到6月26日（周一），吵架無果，同意。周六、周日晚上兩次去出租房查看，有Uhaul停在門口，確實有在搬家。
6月26日，房客又發來短信，說要再推一天至6月27日下午2點。（每次都有很好的借口，略過）。
6月27日上午，又要求推到傍晚，當天傍晚我去了出租房，發現大部分東西都搬走了，隻剩下一些雜物。（屋內各種損壞，略過）。房客又要求推延至6月28日下午才交鑰匙。
6月28日上午，又要求推延至傍晚，不同意，又是短信各種漫罵（略過），擺出一副破罐破摔的姿態:"you can file eviction, let judge pick the time (for move out)"，然後說她“會搬完後，把鑰匙放在廚房，再通知我”。
6月28日傍晚，轉換策略，跟房客來軟的，給她們買一些Pizza等食物，希望她可以今天給鑰匙，然後在屋外車內等房客搬完東西。將近10點，房客說還有內個箱子的雜物搬不完（車子也裝不進），要求再過一天才交鑰匙，然後讓我進屋查看。確實隻剩一些雜物。我同意了，然後好言請房客簽一份，"Move out & Release Form"(如圖），意思就是“確認她搬走了”。（貼圖不知道能不能成功，主要內容如下）
- MOVE-OUT. The Tenant agrees to vacate and move-out of the Leased Premises by June 28, 2023, unless already moved-out at the time of writing this Release. And deliver possession of the Leased Premises by returning the keys (and garage door opener) to Landlord.
Tenant affirmed XXX & XXX had already move out, there have not been and are not now any other persons residing at the Premises.
Landlord was authorized by Tenant to throw away any personal possessions left at the premises or property after the above said date of Move-out.
If the Tenant does not move out by the aforementioned date, the Tenant shall be in default of this Release, any and all claims, demands, liabilities, and causes of action shall remain in place.
- SECURITY DEPOIST.
Landlord will furnish Tenant an itemized statement indicating the amount of any security deposit received and the basis for its disposition within 21 days after delivery of possession. The security deposit will being applied first to any damage and cleaning and then to any unpaid balances (e.g. rent, utilities). This is in accordance with California state law Civil Code § 1950.5(g).
（當時，房客有問一句，她明天還要來搬東西，我們會不會真的把她的東西丟掉？我說不會。然後房客簽字了。之後又要她簽一個Move-out Check List，標明一些損壞的項目，她拒絕了。）
今天（6月29日）早上，房客又發來一大堆短信各種漫罵，說我是HARASSMENT, ILLEGAL, 非法逗留、不肯離開、強迫她簽字等等，絕口不提“交鑰匙、搬走餘剩物口”。
我還沒有回複，因為不知道要怎麽回複？！
比較缺少跟惡房客鬥爭的經驗，請教大家，特別是檸檬兄和朽兄：
1. 這種情況下，房客簽了"Move out & Release Form"，我算不算已經把房子拿回來了？
2. 房客沒有交鑰匙，（我有一套備用鑰匙），我是否可以自由進入房子了？
3. 如果房客沒有來把剩下的那些物品（總量大概4-5個塑料箱子），怎樣處理最好？丟掉？通知房客？放18天？
4. 房客今天早上的這些短信，我要不要回複？澄清我隻是delivered food & drink for them, politely waiting outside in the car, never forced her to sign paper etc. 如果不回複？會不會等於默認房客的指責？
5. 我是希望盡快開始清理、整修這個房子，因為得花大量的時間費用整修呢。這個房客連我的Stove都給賣掉了，裏麵就跟豬圈一樣。
