The property record is public.  The easement is on the public record. You should have done your research when you made the offer.  It's the standard of "knew or should have known".  

Don't blame your lawyer.  You have no case.  Either proceed to close or lose your deposit.   

It doesn't matter if you hire the best lawyer in the country.  You have zero chance to get your deposit back.
