美國法庭問題思考

美國法庭在輕罪判決後不可以上訴，這樣就對法官沒有了製約力，如何能夠保證公平？難道靠道德嗎？

在中國大陸，判決後不服可以在指定日期(10日)內上訴至上一級，而美國沒有類似機製，是否說明中國更有人權？
