Clearly, this law111 has no knowledge of China's family law, which provides that children have duties to support their elder parents. Please note the complicated nexus between laws, cultrues and traditions. China has a long tradition that parents raise children for later support purposes. The law-makers and enforcers cannot blind their eyes to this existing custom in the society, esp. where the goverment at the current stage is incapable of bearing the burden of supporting senior citizens through establishing a nationwide social security system.
Besides the issues of jurisdiction and conflict of laws, it rests with the court's discretion to entertain equity in order to resolve the dispute between two parties. It will be a tough judgment because the complainant did not fullfil her duties at law to foster her minor child either.
