Overall, your case is a bit complicated. You'd better to seek some advise from your family lawyer. The insurance company should be on your side. This is because they are the next liable for claims if they cannot get from Hertz. Hertz may be liable for claims of your passenger's claim not fro yours; most contracts write in that way. But if all other passengers are signed as drivers, they would reject your claim the first and wait to see how the case evolves - it is a rather headache process.

If you have much property on the stake, the court's decision will allow the passengers to go after your belongs. If otherwise, it doesn't matter much. So you need to evaluate your own situation and consult with your own lawyer.
