The plaintiff's lawyer is the one who sued you on behavior of the passenger. By referring him to the insurance lawyer, the latter has to deal and work with the Hertz departments; otherwise, the insurance company has to pay all $50k. If they can have Hertz cover as the first insurer, it saves their money. That is their interest.
So don;t have to worry too much. But I still suggest you to find an experienced lawyer, when it becomes necessary.
