請教各位大俠jaywalking

一個行人在路口過馬路時被左轉的車撞傷，司機和另外的兩個證人說行人是jaywalking ,可行人說他是在行人通行燈變綠時才過的，在快到達馬路正中央的時候被撞。這個在法庭上有可能被認定嗎？
