Medical malpractice litigation accounts for 0.3% of overall health care spending . (5.8 billion  / 2.6 trillion) (see http://www.justice.org/cps/rde/justice/hs.xsl/8686.htm). 

It is near impossible to file a frivolous lawsuit in medical malpractice -- please tell me, how?.  And -- you can file a lawsuit all you want, but the insurance company will never pay unless your case is meritorious.  They will fight tooth and nail rather than paying a frivolous claim.
