是請HR給我一個LAYOFF的機會(當然不一定會同意)還是我直接QUIT走人?

 

- Do not ask for layoff. First, it doesn't look good for you. Second, it may backfire. If the HR people are competent, they wouldn't lay you off with a package. It may backfire to the company with legal issues.  If you have decided, call it resign, not quit.

 

另外LAYOFF是否會對我未來的職場生涯產生影響?

 

- Layoff can be due to a variety of reasons. A good employee may get laid off in scenarios out of her/his control, like the company was undergoing financial hardship, etc. As long as you can give a reasonble explanation, it will have no effects on your career. 

 

因為工作OFFER是AT WILL,我能否跟HR說周一就是我最後一天,是否會有法律糾紛,還是準備兩周的NOTICE?

 

- If it is at will, you can leave right after you submit the resignation letter.  It is not a good practice, though.  It is not professional in most scenarios. It may burn the bridge.  It is the manager to who you don't get along with, not your team or the company. It would be better to give two-week notice, and transfer your work/projects to other people professionally. 

 

我的假期沒有用完,是否有法律保護假期能夠折算為現金?

 

- It depends on the company's policy. You can ask HR.

 

REFERENCE已經想好,如果我沒有提供直接經理的名字,未來的背景調查公司是否有種種方法查到直接經理的名字做調查?

 

- Usually the future employer will not spend the efforts to dig out a regular candidate's past managers to call them, if they are not in your reference list.  When you are asked why you left the previous company, you do need to think out a good reason, like more challenges, career advancement, family reasons, etc.
