1. It appears to me that it is lay-off - performace issue is just an excuse.
2. Better not to sue the company and just move on as law sue is going to be time-consuming and possible ruin his/her reputation in the industry.
3. Your friend can apply for the unemployment insurance if he/she can prove that continuing work was not available to him/her and your friend didn't do anything wrong.
