Seriously, it all depends on how critical the proprietary information at issue is to his ex. If it is only nominally important (i.e., translates into little to the bottom line), an apology plus returning the severance package will likely get him off the hook. If, on the other hand, the proprietary information means priceless trade secrets or similar gold, he stands a good chance to lose everything he owns, and much much more, including his professional rep, however much, or little, he had to begin with.
Regardless, he got himself into a very unpleasant spot. And he likely needs the service of a decent lawyer, not a fraud like me.
Lose his shirt, and pants? But I guess he would not mind...
