我有個商標糾紛。一公司告我商標與他們商標混淆。商標局裁決我輸。我自己代理自己上訴聯邦巡回法庭。
有個小問題，非常想知道怎麽回事。
法庭規定對方在今年五月18號得回複我的上訴。

對方沒file response till now. 我以為他們放棄了，可是今天他們又file 一個 entry of appearance 加了一個律師進團隊 （5/30/2018）, 表麵他們沒有放棄.
他們沒有file motion for extension of time so far 。
我的informal brief of appeal 是4/3郵寄出，法庭4/9收到，對方4/10收到，法庭記錄是4/17輸入。法庭確定日期文件是4/24 他們有什麽理由過了12天還不file response? 時間不夠，可以要求延期。他們沒有。難道是他們可以定義他們的回複為formal, 所以可以ignore 法庭指定的 file informal response brief?正式回複和非正式回複期限不一樣？（40天，21天。怎麽算） 他們是個大律師事務所，應該知道怎麽做吧？如果錯過期限會很麻煩。難道 因為他們的回複是正式的，他們自己可以認定期限？那可能嗎？那又是哪天。
很好奇。打電話給法庭，法庭說他們錯過期限，得file a motion 解釋誤期原因，法庭決定是否接受回複。問一律師，律師說他們必須在5月18回複，除非申請延期。非常好奇。到底怎麽回事？有專業商標法律師有解嗎？
