老畢風波過去好多天了，可還是不斷見到有人為他打抱不平，比如說這是他的“言論自由”，“他有罵的自由”，“起訴也沒有任何法律依據”什麽的，不一而足。其實每個人小時候家長都會教給你不要罵人，成人社會裏不論在工作還是在家裏罵人也都是被人不齒的，很多人也為此付出了很大的代價，比如失去公司、工作、甚至家庭。但既然那麽多人以為可以隨便罵人，那就從作為道德底線的法律上說一說老畢到底能不能罵人。
先看看普適價值的先驅法國可不可以罵。2003年1月23日法國通過了國內安全法，裏麵規定（http://www.theguardian.com/world/2003/jan/15/france.jonhenley）：
Swearing at a policeman, government official or any "person invested with public authority" could bring a fine of up to €30,000 (£20,000) and a two-year jail sentence, while uttering a death threat could cost €75,000 (£50,000).
就是說辱罵警察、政府官員、被公權授權的人員是犯法的，會判兩年監禁並處罰金若幹。
保護言論自由最力的普適國家美國聯邦法院有判例說明從原則角度講是不可以在可能立即引起暴力的情況下罵人。但各個州的法律又不一樣，我們來看幾個例子：
一、密執安州法律認為隻要有女性和兒童在場罵人就是犯法的（http://www.legislature.mi.gov/%28S%28eblto5zu45pl4l431bfithvf%29%29/mileg.aspx?page=getObject&objectName=mcl-750-337&highlight=750.337）：

Act 328 of 1931
750.337 Women and children; improper language in presence.
Sec. 337.
Indecent, etc., language in presence of women or children—Any person who shall use any indecent, immoral, obscene, vulgar or insulting language in the presence or hearing of any woman or child shall be guilty of a misdemeanor.
二、俄克拉荷馬州法律也認為隻要有女性和兒童在場或在公共場合罵人就是犯法的（http://www.oscn.net/applications/oscn/DeliverDocument.asp?CiteID=69426）：

If any person shall utter or speak any obscene or lascivious language or word in any public place, or in the presence of females, or in the presence of children under ten (10) years of age, he shall be liable to a fine of not more than One Hundred Dollars ($100.00), or imprisonment for not more than thirty (30) days, or both.
三、羅德島比較嚴格地認為隻要罵人就違法（http://webserver.rilin.state.ri.us/Statutes/TITLE11/11-11/11-11-5.HTM）：
TITLE 11 Criminal Offenses
CHAPTER 11-11 Disorderly Conduct
SECTION 11-11-5
§ 11-11-5 Profanity. – Every person who shall be guilty of profane swearing and cursing shall be fined not exceeding five dollars ($5.00).
還有很多州有類似的法律，不多說。除此之外，美國還有很多州有褻瀆神明罪。中國有很多人在汽車裏掛毛的像以求保佑，也可以算是神明了，何況毛是寫在中國憲法、還有老畢還在的黨的黨綱裏的。你當然可以不同意，可一個人的粗話是另一個人頌歌（One man's vulgarity is another's lyric），就像穆斯林和基督徒如何看待對方的宗教一樣。
你一定會說這些都不是中國的法律，那我們來看看中國法律怎麽說的（http://www.npc.gov.cn/wxzl/wxzl/2000-12/17/content_4680.htm）：
中華人民共和國刑法第二百九十三條 有下列尋釁滋事行為之一，破壞社會秩序的，處五年以下有期徒刑、拘役或者管製：
。。。
（二）追逐、攔截、辱罵他人，情節惡劣的；
。。。
知道了吧，罵人在中國也是犯法的。結論是老畢是不能罵人的，不論在哪。
