Hi. This is our 3rd case for eviction but this time is a little bit different.
Background: One Mexican couple lived in one of our apts for about 1.5 years. This Oct. they bought a house and moved out. They told us they would have their two nieces to move in and finsih the lease which ends at end of next July. The two nieces moved in early November and paid the rent for Nov, but not this month.We confronted them two times and they kept saying payment would be made, but they cannot keep the promise. We post the "Pay rent or quit" notice on 12/12/2012 and expected to file eviction after Christmas. (In this state it is 10-days period for pay or quit).
Our mistake is: we did not added the two nieces' name into the original lease on time. (Right now it is hard for us to do so because we already warned them for eviction.They will not cooperate). Since the two nieces were not on the lease, we have to address the Mexican couple plus two nieces on the "Pay rent or quit" letter.
Questions:
1. Is that ok for us to address Mexican couple (lease holder) plus two nieces on the pay rent or quit notice? (two nieces are not on the lease but currently live in the apt).Or any better solution?
2. We do not know the Mexican couple's new address, was that ok for us to post the pay rent or quit notice on the door of our apt? Is that considered that the notice was delivered on the court?
3. Can we sue the two nieces for trespassing? We have already took their one month's rent (November), so it seems we admitted their moving-in, though no paper work with lease. What can we do to get them moved out?
