Ask the agent buy you a new AC or contribute 4K for your closing cost, here is the reason he should do it: 1. He conveyed wrong, material facts, which is inexcusable. If you refer him to the state real estate agent board, he will be in trouble, 2. He is earning 5-6% commission, which he should share with your agent if you have one. So he is earning double commissions, should credit back to you some amount, 3. If you back off now, he will need a new buyer, and it will take another cycle for the deal go through for him to earn the same commission. So he should very eager to keep you as the buyer and close the deal. 4. If you back off now, the new buyer may have their own agent, and he has to share 2.5% of the commission with buyer agent. 5. If you back off now, the bank may not use him as an agent, so he will lose all commission. This is not likely, but possible to happen. So ask him to contribute 4 K for your closing cost, if he is smart enough, he will do it. And also remember, if you sue a dual agent for any reason, very high chance he will lose because the fundamental flaw of being a dual agent.
