If it's apartment building or townhouse, there will be HOA. If the builder wants to sell, they have to get final DCA approval. To begin with, builder will have control over the HOA, which later will be handed over to individual home owners.
So there will be a HOA. To say builder doesn't know that, or it's none of other's business, it's purely BS. It's illegal to sell without final DCA. All the information will be in master deed, public offering, etc.
