買房的問題出來了，能不能拿回deposit

原計劃這周五close,但是前幾天大雨，seller星期天剛剛回來，然後發現地下室進水，但是不說具體情況，隻說地毯濕了。現在我們約contractor去看,seller也在拖檢查的時間，這種情況能不能拿回deposit,有什麽注意事項?
