給自己挖了個坑？進退兩難？求幫助！

一年前租給一對研究生，每月租金due on 15th。一個月前告訴我8月15日租約到期後不再續約。7月15日男的付了一半的租金，另一半租金一直沒有音訊。直到我28日去信問，女的給我會信，說他們遇到經濟困難，想用押金付另一半的房租；但是看了租約，不允許，想跟我商量通融。最可氣的是在信中說她將在8月初拿到第一筆工資，但要用於支付新出租房的押金，所以無法付給我租金。我去信不同意，給了3天的Notice。今天回信說他們研究了租約，根據租約，他們還沒有in default. 因為租約寫：“

38. DEFAULT. Tenant will be in default of this Lease upon the occurrence of any one of the following events:

(a) failure to pay rent or any other amount hereunder within 30 days after it is due;

(b) failure to perform or comply with any other agreement, term or condition of this Lease;

(c) abandonment of the Premises;

(d) any misrepresentation or omission of Tenant or any guarantor made to Landlord in connection with this

Lease; or

(e) assignment for the benefit of creditors by, appointment of a receiver for, or any filing of a petition under any

bankruptcy or debtor's relief law by or against Tenant or any guarantor.

”

根據這個租約，30天之內不付租金才為毀約。但是30天就是8月14日，那天剛好是整個租約的截止日(午夜12點）。這樣他們就不構成毀約了。

各位有沒有碰到相似的情況，如何對待。我是不是應該將以後的租約改成20天不付租金後就構成毀約，以防止同樣情況再次發生。謝謝。
