Sorry, no. In order for him or his insurance company to pay you, you have to prove that he is legally liable due to being negligent. Since he fixed his AC after you notified him, so he is not negligent. You better file with your own insurance carrier or fix it out of your own pocket if the cost is lower than your deductible.
