我有一個大老粗房客，一個多月前搬走，把我的房子搞得一蹋糊塗，我一生氣把他的deposit全扣了，一共2000塊，還給他一個itemized deductions。這個鳥人還真不是個省油的燈。找了個律師直接給我來信。隻承認其中幾項共750塊，要我在10天之內退還他剩下的1250塊。下麵是這個律師的信的部分：

At this time, my clients are demanding that you refund $1,253 of said deposits back to them via cashier's check made payable to Mr. and Mrs. X and mailed to my office so that it is received no later than June 25, 2012.

As you may be aware, Section 92.109 of the Texas Property Code states that a landlord who retains a security deposit in bad faith is legally liable fo the sum of $100 plus 3x the portion of the deposit wrongfully withheld plus the Tenant's reasonable attorneys fees in a lawsuit to recover the deposit. My clients are fully prepared to file an appropriate lawsuit against you to recover said damages in the event that you do no comply with the above stated demand.

Also, please be further advised that you or your attorney may contact me to discuss thi matter in an effort to resolve this matter fairly without having to resort to litigations.

我覺得這律師前兩段特硬，最後一段好像又變軟了，想私下和解的意思。

其實我大部分他搞壞的東西都有照片記錄。不過有的東西沒辦法照相，比如說trash disposal，或者有些damage是邊修邊發現的，就忘了照相。

有的材料用的是原來買的多剩下的東西，所以發票的日期和數量不對。

大部分修理我付支票，少數的因為數目小，handyman堅持要現金，我就給了現金，沒發票。

他覺得他不應該付carpet cleaning, house cleaning service, 其實這些我覺得在德州應該是房客付的。

另外有些東西他確實搞壞了，不過還能湊合著用，所以沒有換。

如果真要打官司，我必須每一條都要用發票證明嗎？

我還真不是slumlord,愛惜房子的房客搬走，我一般不扣錢，或則隻扣他們損壞的東西的一點錢。他們實在是太糟糕的房客。

不過我也不想打官司，我沒有時間跟他們耗。所以我想著讓一步，稍微退他一點錢把這事給了了。但我不能按他要求的退，確實他損壞的東西太多了，我的損失遠遠不止750塊。

所以我想和他negotiate一下，有幾個問題。

我應該找他還是找他的律師？
我自己要不要請律師，如果請，大概多少錢？
如果我不找律師，自己和他們談，我要注意哪些方麵？不想被他們抓住把柄。
他們人已經不在本地了，他的律師能代表他們出庭告我嗎？
如果真要出庭，是不是不光他們不同意的東西我要出具證明，他們同意是他們搞壞了的東西我也要出具證明和發票。
