現在under contract的那個房原來有一個有Hubbard clause 的contract, 就是buyer #1買房子是contigent on他把自己的房子賣掉。但是如果seller決定接受其他offer了,給buyer #1 24小時做決定,是remove contingency, 還是release。我們那個buyer #1 在24小時告訴他自己的agent, 他release,那時是晚上8:03。所以我們作為buyer #2 就和seller 在9pm under contract了。結果第二天早上11am, buyer #1(他自己是律師) 說他改變主意了,房子還是他的。
現在我們都不讓。listing agent's attorney 認為房子應該是我們的.
buyer #1 is claiming since there was no “time is of the essence” and due to the Statute of Frauds, that he still has the right to go forward .He explained that he does not need to sell his house to buy the house[not sure how true that is].
We claim "we have a bona fide contract, that the first buyer has not dealt fairly , that we are the only party with “Clean Hands’ in all of this and expect to buy the house".
周五要inspection了,如果拿到房子的可能不大的,不想浪費那個錢了。大家幫我看看?
