It seems that I'll have to settle regardless:

Does the following in my contract say that we have to close the deal and then evict the seller? Does it allow me to walk away and not settle? I don't feel like to close the escorw and then evict them, if they don't move out.

"Possession Date: Unless otherwise agreed to in writing between Seller and Purchaser, Seller will give possission of the Property at Settlement, including delivery of keys, if any. If Seller fails to do so and occupies the property beyond Settlement, Seller will be a tenant ar sufferance of Purchase and hereby expressly waives all notices to quit as provided by law. Puchaser will have the right to proceed by any legal means available to obtain possesion of the Property. Seller will pay any damages and costs incurred by Purchaser including reasonable attorney fees.
