The tenant called me and cried in the phone about her unfaithful hu*****and. And she said she has to move out before the end of the lease. I was nice to her and agreed to let her leave at the end of Janaury 2012 without the penalty. The contract does not say specifically about the penalty if she breaks the lease. But I told her she has to clean the house if she wants her deposit back.
They moved out and the hosue was empty. But a few things broke. I charged her for the part of the deposit and mailed her the balance. The most expensive charge is $525 for the coil and blower cleaning. It is very dirty and obviously she never changes the filter. And the contract states that she has the reposibility to change the AC filter. She called me and told me that she is going to sue me. I have all the evidence to show the dirty coil. I even agree to pay half of the coil cleaning. But she wants me to pay the full. Plus she always pays the rent later and for many time, I forgave the late fees charges.It seems unfair to me if I have to pay the whole charges. And many evidence shows she did not take a good care of the house.
Is there any chance that I will lose the case if we go to the court?
