In the United States, the Copyright Act defines "derivative work" in 17 U.S.C. § 101:
A “derivative work” is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications which, as a whole, represent an original work of authorship, is a “derivative work”.

Q:要到何種改寫程度才不能算derivative?
A:這是個 question of fact, 要打官司才能知道。 問題是,你願意冒這個風險嗎? 別忘了,人家是有版權的。 就算你願意,你能找到願意冒這個風險的出版社嗎?
Q:你說“whether you have liability or not is a different question”又如何解釋?
A:是否侵權和如何賠償是兩個概念。 當然了,侵權是賠償的前提,但是這不代表侵權了就一定有賠償。 如果那本書在美國沒有注冊,按照版權法的規定,作者也還是有版權的,因為有沒有版權和有沒有注冊無關。 隻要寫出來,就有版權了。 但是如果他沒有注冊,就沒權力告你侵權,也談不上或得賠償。 可是你的確是侵權了。
