I wanted to get about 80 yards fill meterial for a big hole in my yard so I called arouond. Three quotes ended up:
Quote1: $150/load delievered from Milford CT (20 miles away). One load is about 20 yards.
Quote2: Free material but no delievery. That means I have to arrange the pick-up, which is $17.95/hour if rent a pick-up truck from HomeDepot. Of course, the cost of two man labor, $50.00 /day ( Mexican)
Quote3: $250.00 for all, delievered (8 miles away)
Obviously, the 3rd one is the best choice.
I called the lady and placed the order. She told me about 6 trucks and the delivery would be starting at 8:00a.m. the next day. They showed up for the first truck at 9:30a.m. Then 4 more truck afterwards.
The problem is: I got an invoice for $2500.00, which was 10 times of the original quote. The driver told me that they sale the fill material for $35/yard. I did not want pay for this bill. they said that I made a mistake for the price and will ask their lawyer to sue me.
I am preparing for the case. The data I have on my hands:
1. The calling records from my cell phone ( to each of the above quote);
2. Hand writing notes for each of the quote I got while I was on phone with them. (It has become a habit for me to write down the information while I am on the phone just in case I miss any important info.)
3. One online pages shows the quote for the free material.
4. I told my hu*****and about the decision and these three quotes the day before the delievey.
5. They claimed $35.00/yard, the total price should not be $2500.00, should be $2800.00.
Actually, I was prepared to pay half of the price, even though I thought it was redicolous. But the lady was so rude and did not give me the chance to say so....
Any chance I will win the case ?
Any professional inputs will be highly apprecaited.
