小孩在 DAY CARE 嚴重受傷, 不知可否采取法律行動.

我們在 CALIFORNIA.

我兒子現在兩歲不到一點. 今天下午, 他在DAY CARE 裏抓住門把手晃著玩. 結果手從門把手上滑下來, 額頭撞到門下邊的突出的金屬框架. 傷口有 4 CM 寬. 送到醫院裏, 縫了七針. 醫生說, 以後肯定會有傷疤.
DAY CARE 裏的主管說, 這樣的事情從來沒有發生過, 因此也沒有預見到有這樣的危險性. 但是, 我認為, DAY CARE CENTER 應當有足夠的經驗預見到這種情況. 由於傷得實在太嚴重, 我在考慮法律行動.

但是, 在我兒子入學的CONTRACT上, 寫著: "I agree to be solely and completely responsible for any medical treatment and transportation costs rendered, if necessary, to my child. In consideration of this authorization, I hearby waive and release any claims against ...... and its employees."

在此請教法律專家, 如果我們嚐試法律行動, 會有什麽樣的結局?

不知那位有名的"單身老貓"有何高見?
