緊急求助!

兩個星期前車被別人撞了. 對方的錯.當時叫了警察,這點沒有爭議.對方保險公司評估為:"Total loss".評估者的推薦理賠價為$6700+5%sale tax$335=$7050.我們那輛車的市場價大約在$7500-$8300.想想胳膊拎不過大腿, $7050 就算了.自己貼點錢再去買輛車算了.但問題在於現在保險公司堅持要扣除$335 的稅.隻賠給我們$6700.我們覺得太欺負人了.我們失去了我們的車(保險公司把我們的車當廢車已經處理掉了);全家受到驚嚇;身體受到輕傷;再買一輛車我們還得額外負擔5%sale tax,rgistraion fee, title fee, inspection fee, mechanic fee...他們賠的錢根本就買不到一輛類似的車.保險公司的人說他們"公司就這policies.你不滿意你去法庭告我呀."

實在是欺人太甚.如果我們想去法庭告他們的話,應該去什麽法庭? 如果我們要求他們賠$6700加上5%sale tax,rgistraion fee, title fee, inspection fee, mechanic fee的話,有什麽法律依據嗎?他們一口咬定5%sale tax,rgistraion fee, title fee, inspection fee, mechanic fee...這些費用是你自己再買車的費用,跟他們無關.但其他保險公司的人都說5%sale tax是應該賠的.如果我們去small claim court的話,高限是$2000.我們的錢好象是超過了.我能隻起訴5%sale tax,rgistraion fee, title fee, inspection fee, mechanic fee這部分嗎?多謝哪位高人指點指點.
