關於加州離婚

結婚3年，孩子兩歲，他是H1 簽證，還有一年就要到期了，要回國，我是H4,像這種情況如果再加州離婚的話財產能不能平分，因為我沒有工作，婚前幾乎沒有財產。孩子判給誰的幾率大，如果他爭得了撫養權，財產如何分配呢？
像這種情況是美國，中國哪裏會更有力一些呢
