求助：追尾被告怎麽辦?

去年二月的一個晚上，老公開車不小心在一路口發生輕微追尾，前麵的車尾和我們自己的車都沒有明顯撞痕，警察來過寫了報告，我們也報了保險公司。當時對方叫了911，所以救護車也來了，把對方車上的兩個人都檢查了一下，沒事後我們才離開。之後，保險公司包修了對方的車，車主倒沒事了，那個乘客卻一直跟保險公司扯皮，估計他確實沒受傷，所以一直沒從保險公司那得到好處。一年過去了，卻突然收到法院的通知，說是這小子把我們告上了法庭，索求傷害賠償五十萬。法院要求三十天內有答複。

這樣的事情大家碰到過沒有？怎麽處理才好？有不有可能dismiss the case? 如果真上法庭，需要注意些什麽事項？
