Land/tenant is regulated by the state. The case law in one state is not binding on the court of another state. I do not think your situation is so serious that you have to make a persuasive argument in reliance on case law. Just check the landlord/tenant statute and then argue the facts. It usually ends up with a settlement. Your landlord must establish damage but it seems from what you said he/she cannot do so.
