各位大師，請求幫助！！！

2010年12月買的房子，一年後的今天，發現一樓的房頂漏水，樓上正好是主臥室的浴室。後仔細查看，屋頂修過，被人割開一個L形狀的口子，修繕後重新封好的。請問是不是可以找上家，有法律依據嗎？他要耍賴可正麽辦？一家老小很是無助，求大師指導，謝謝！
