遇到無理房東，該怎麽對付？

租住在一個兩家庭的house 的一樓，房東家住樓上，房子隔音效果非常差， 房東家兩個男孩，天天在樓上跑來跑區，而且他們作息很不規律，經常早上4， 5 點就開始活動，住在樓下實在無法忍受，房東人很粗魯無理，說就是這樣，受不了可以搬走（租房時，房東一家不在，其朋友幫他出租的）， 而且要他維修的地方他也不修。 當時填了一份申請，交了一個月房租的定金，並沒有正規的lease, 沒有注明租住期，當時是口頭約定。現在如果搬走， 房東能扣押金嗎？ 若他扣押金， 我可以訴他嗎？有什麽地方可以製約他嗎？ 能最後一個月房租不付也不要押金走嗎？謝謝個位建議。
