whether the premise is habitable or not, is not decide by the tenant.
if the tenant believe the premise is inhabitable, he/she can call the health department to inspect the home, which only they can condame the property.
what you suggest, may cause this tenant more problem down the road. the best way is to talk with the landlord, and give 30 days advance notice to break the lease.
