On 2008, I used Dependent Care Flex Spending Account for the first time. I put in $5000 and totally forgot about it until I do my tax this year. (I had an accountant to do my tax last year) I called the company HR. They refused to give any part of my money back because I passed the claiming period eventhough I can provide receipts from the Pre-School from 2008. Is there anything I can do about it? Even to get partial money back?
My argument point is the "use it or lose it" policy. I actually used up all of the money on Child Care during that period, I just didn't know that I had to a form to get the reimbursement back. Does that mean I have to lose all $5000 hard earned money?
Any help will be appreciated.
