Filing I-140 under F1 or H4?

Dear friends,

My current status is F1. My hu*****and has got his LC approved and we will be filing I-140 together. Our lawyer is recommending me changing from F1 to H4 before filing I-140 because F1 is a non-immigrant visa.

I would appreciate very much if you could offer me any suggestions.
