I'm not having RA at school any more, and will be graduating in 6 months. I was thinking that I can use OPT to work if I maintain F1 just in case EAD is not issued by then. I'm afraid that I might not be able to secure an H1B in near future given the circumstance.
We'll be filing I-140 and I-485 simultaneously. The lawyer says that the risk we are running if I remain F1 is that the case being denied and proceedings being started against me as an F-1 student with immigrant intent, which they seem to be not confident enough to appeal. So they highly recommend changing F1 to H4.
Is there any ground in the lawyer's concern and should I follow their suggestion?
