I140 NIW 被拒, 求助!!

今天收到了律師的信,告知我的I140-NIW被拒.在決定是否appeal之前,想在版內請教一下大家的意見.

我的情況大致如下:

差不多一年前開始辦,當時我是一個4年級研究生就讀於一所top 10 medical school. 當時我還沒有取得任何博士或碩士學位.但因為我有比較強的publication（13 papers on PNAS and JMB, half of them are first author）和推薦信(5 letters from faculties in our school including the department head (academy member), 1 letter from a Nobel laureate at Harvard (academy member also), 和律師(一個有名移民律師事務所的)談了我的情況後，他認為我隻要去做一個degree evaluation，這個case就是可以做的。通過律師介紹，我花了 $150做了evaluation.然後於今年初3月份交了我的petition. 當時的合同是先付$2000,I140下來後再付$1500.
但今天律師告訴我,我的case被拒了.但是他認為” The INS denied your application solely based on the fact that you do have a Ph.D. degree, which is legally wrong. Based on our experience, I have confidence in an appeal.” 我需要再付2000 辦理appeal.(1000 事先付,事成後再付1000)..
有幾個問題想請教大家,
1. 我的case 的weakness到底在哪裏? 如果按照律師的話來理解,難道我有PHD會反而weaken我的 case嗎?
2. 是重新找個新律師開一個新case,還是appeal, 哪個更好?因為就價錢而言,並沒有很大差別.當然在時間上,前者會損失很多.
3. 如果appeal,成功可能有多大? 是否有必要補交我的PHD證書? (我剛剛拿到我的PHD學位)
4. 律師要求appeal的價錢是否合理.
