回複：N400被拒的問題

今天早上從網上剛剛看到的N-400 denied decision。我的情況有點複雜，希望大牛幫助一下。
 

我是2005年9月交的140和485，但是沒有選黨員這一條。2006年4月140批了。然後485一直等，infopass幾次發現是name check的問題。然後和律師商量，被建議應該把黨員填上，然後就在2007年9月交了一個補件，說是黨員。在2008年5月485也批了。今年10月變公民，10月底麵談。那個IO問我是不是黨員，我說是，她說我應該在申請的時候的就填是黨員呀。我說我在2007年有一個補件。她說沒有找到，讓我把那個補件fax給她，並且要service center的收據。第二天我的律師把補件和收據給我後，就fax給那個IO了。今天看到的denied decision。
 

我是2001年出國的，2001年底就不是黨員了因為不交黨費，現在有單位出具的不是黨員的證明。但是規定是5年以後才可以申請移民。我是2005年10月申的，不到4年。但是2007年9月交補件的時候，5年已經過了。
 

問題是，
 

1，這個denied decision會不會影響我的綠卡。-The N-400 denial itself does not affect your green card validity.
 

2，如果交N336 appeal，如何操作。
-Just follow the N-336 instructions. You need to submit Form N-336 with fee within 30 days after receiving the denial notice of N-400.  Once you submit the N-336, you can have a hearing scheduled before an immigration officer to present additional documentation and testimony in support of your eligibility. Prepare the evidence you mention above to justify your case.

我以前的律師在東部，我現在在加州，是不是應該找個當地的律師。-If you want to find a lawyer, you had better find one in your current resident area because it will be convenient for the lawyer to show in the USCIS local office with you, if necessary.

大牛們給到意見，並且推薦一個好律師把。我在san Francisco.-This is a simple case, and any professional immigration lawyer will be fine. You even may not need to hire a lawyer. As long as you show the evidences and justify you did not hide anything when you applied for the green card (no fraud), you will be fine. 
 

 

2006年到2008年，為了搞這個name check，給議員，first lady寫信，做各種clearance，這些文件還都留著呢。
