thanks a lot, 8老師. My chinese colleague tolde me he really had hard time to convince our company lawyer to agree applying for EB1-B, so I do not think I can apply EB2 and EB1B the same time.
-You told them that you will hire a lawyer for EB1B and pay the fee by yourself to see what they say.
In this case:
1. is it better to try EB1B firstly ? if so, what is the best Reason to make our compay lawyer agree on applying EB1-B ? told him my H1B will experie before green card ?

2. Can I still appy for EB2 if I fail on EB1-B.-Yes. But I still suggest you to file EB2 first if the company does not agree to do both at the same time. You need an approved I-140 to extend your H-1 beyond the 6 year limit and this is more important to you because you need to survive first. Because your EB1B qualifications are not very strong, and thus it is risky to your H-1 extension.
