8 teacher,my perm is only pending 3 months now

I filed first perm in end of 2008, 8 months later, got audit, submitted doc in one month and waited until feb of 2010, denied, and filed second one in July 2011 (lawyer filed for me), and it is pending 3 months now

filed H1B extension (included the one year) in Aug 2011, it is pending.

then for the situation I mentioned in previous link, will I be out of status?

"Thanks, 8 teacher, if H1B extension (submitted on beginning of Aug) is only approved for until middle of Nov,and my perm is still pending in middle of Nov, then after middle of Nov, won't I be out of status? if that case, how do I keep in status?"
